We have created this privacy policy in order to disclose the information gathering and dissemination practices for this Internet-based community portal.(hereafter the "Site"). This privacy policy explains:

  1. What personally identifiable information we collect from users ("User Information").
  2. How User Information is collected.
  3. How we use User Information.
  4. With whom we may share User Information.
  5. What choices are available to users regarding collection, use, and distribution of their User Information.
  6. What types of security procedures are in place to protect against the loss, misuse, or alteration of User Information collected.
  7. How users can correct inaccuracies in their User Information.

Information Collection and Use

Pulte Homes, Inc. ("Pulte") and ICI Services Corporation are parties to an agreement under which ICI Services Corporation made the Site available to your community homeowners association or community developer. Your community homeowners association or community developer ("Licensee") has engaged ICI Services Corporation and/or its affiliates (collectively "Provider") to develop, maintain, host, and support the Site for your community. Licensee and Provider are hereinafter collectively referred to as "we", "our" or "us" in this privacy policy and each of Licensee and Provider is equally bound by the terms of this privacy policy with respect to its use of your User Information. User Information will also be made available to Pulte for the purposes set forth in this privacy policy. Pulte is contractually obligated to maintain the confidentiality of User Information in accordance with this privacy policy and to use User Information solely for the purposes described in this privacy policy.

Certain information is collected in connection with your use of the Site and the services available on the Site (the "Services") and such information is accessed and used by Licensee, Provider and other users of the Site, but remains the sole property of Licensee. Provider may, in connection with the performance of the Services and the hosting and maintenance of the Site, display such information in certain circumstances. For example, each time you post any information on the Site (e.g., group or directory listings, placement of classified ads, postings on message boards, etc.), your name and other User Information will appear.

Registration; Group/Directory Listings and Profile.

In order to use this Site and the Services available via the Site, a user must first complete the registration form on the Site. During registration, a user provides certain User Information (e.g., name and other contact information (and other optional personal information)). Please remember that access to and use of the Site and participation in and use of the Services available via the Site are optional. We use the User Information collected at the time of registration to communicate with you, the user, and for other purposes described in this privacy policy. Users also provide personal identifiers (such as username and password) and indicate personal preferences so we can provide a more personalized experience in connection with the user's use of the Site and receipt of the Services.

Users may select groups or businesses they wish to subscribe to or participate in. Participation in some groups (such as your homeowners association and others selected by Licensee) is automatic but you may opt out later. Directories are provided for the convenience of users. You may opt out of participation in any directory (See Choice / Opt Out below).

We store information that we collect, including User Information, through cookies and log files to create a profile of each user. A profile is stored information that we keep on each individual user that details the user's viewing preferences, which clubs and groups they belong to, areas of interest, content postings, messages, etc. Collected information is tied to that user's User Information to provide information and improve the user experience on the Site. This profile is used to tailor a user's visit to the Site and to direct pertinent information to the user.

Information Use

User Information collected via the Site lets us provide personalized Services and allows us, Pulte and others described in this privacy policy to communicate separately with you. Licensee and other users in the community may also read and access content and materials you post. We also use aggregated information about the use of the Site and the Services to evaluate our users' preferences, improve our programming, and facilitate reporting of Internet usage to our licensors and advertisers. Such information contains no User Information.

Comments, materials or content posted on the Site by you may list your name and the date posted. Such information is also stored for future reference.

Cookies

A cookie is a piece of data stored on the user's computer containing information about the user. We use both session ID cookies and persistent cookies. For the session ID cookie, once a user closes the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user's hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. If users reject the session cookie, they cannot use the Site. Persistent cookies enable us to provide a customized experience on the Site (e.g. maintaining a user-specified color palette). See the "Registration; Group/Director Listing and Profile" section above.

Log Files

Like many similar service providers, we use log files maintained on Provider's servers. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. We use this information to analyze trends, administer the Site, and gather broad demographic information for aggregate use. We also use log files to track users' movements on the Site to determine what portions of the Site are most valued by users and so that we can improve such portions as well as the other portions of the Site that are less frequently visited. With the cooperation of your Internet service provider, it is possible for your IP Address to be used to identify you personally, however, we agree that we will not use it for this purpose, unless required to by law.

Communications from the Site

Special Offers and Updates

We send all new users a welcoming email to verify password and username. Established users will occasionally receive communication from the Community Administrator, other community groups, Pulte and/or third parties described in this privacy policy. Out of respect for the privacy of our users, we present the option to not receive these types of communications. Please see the Choice and Opt-out section below.

Service Announcements

On rare occasions it is necessary to send out a Site or Services related announcement. For instance, if the Site or any Services on the Site is temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications, though they can deactivate their account. These communications are not promotional in nature.

Customer Service

We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account. We reply via email, areas within the Site (Feedback Status) or phone, in accordance with the user's wishes. We track and maintain a log of issues and suggestions along with the user who submitted them so we may follow-up at a later date.

Newsletters

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. If you do not want to receive these newsletters you may opt-out of receiving them. Please see "Choice and Opt-out" section below.

Refer-A-Friend

If you choose to use our referral service to tell a friend about your community, we will ask you for your friend's name and email address. We will send your friend emails inviting him or her to visit the community. We store this information for the sole purpose of sending these emails and tracking the success of our referral program.

Your friend may contact us at support@Intellicommunities.com to request that we remove this information from our database.

Visitors and Guest Users

Persons may also register as a guest user and be granted access to a limited portion of the site containing general community information. No User Information is displayed to guest users. If you are a guest user, you will be asked to provide your name, address, phone, and e-mail address. We may use this information to contact you to provide additional information about the community.

Important Notice

Though we make every effort to preserve user privacy, we may need to disclose User Information when required by law, to cooperate with law enforcement personnel, or when necessary to protect our rights wherein we have a good-faith belief that such action is necessary to: comply with a current judicial proceeding; an active investigation; a court order; any local, state or national law or regulation; or any legal process served on us.

Aggregate Information (non-personally identifiable)

We share aggregated demographic information among our partners and affiliates as described in this privacy policy. We also share aggregated demographic information with Pulte and other potential community sponsors in order to provide them a relevant basis on which to provide community promotions, sponsorship and/or advertising (for example, to a local business willing to provide community members with special discounts). This aggregate information is not linked in any way to any User Information.

Affiliates and Advertisers

User Information is shared among Licensee, Provider and Pulte for purposes of developing, administering, hosting, managing, and supporting the Site and the Services. We may display targeted advertisements based on User Information. Advertisers (including ad serving companies) may assume that people who interact with, view, or click on targeted ads meet the targeting criteria - for example, women ages 18-24 from a particular geographic area.

We do not provide any User Information to the advertiser when you interact with or view a targeted ad. However, by interacting with or viewing an ad you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad.

Advertisers on this Site may include, without limitation, Pulte, financial service providers (such as banks, insurance agents, stock brokers and mortgage lenders) and non-financial companies (such as stores, airlines, and software companies).

Business Transitions

In the event we go through a business transition, such as a merger, acquisition by another company, or sale of a portion of our assets, users' User Information (or the license to receive and display such information) will, in most instances, be part of the assets transferred. Users will be notified on the Site prior to a change of ownership or control of their User Information. If as a result of the business transition, the users' User Information will be used in a manner different from that stated at the time of collection users will be given a choice consistent with the "Notification of Changes" section below.

Electronic Mail

New users will receive a welcome email letter explaining the features of the Site and the Services available on the Site. We may also send periodic emails, to announce important changes, new features, technical issue updates and information about the Site, the Services available via the Site and/or other products and services.

We are concerned about controlling unsolicited commercial e-mail, or "spam." While we continually review and implement new technology, such as expanded anti-virus scanning and filtering features, there is no currently available technology that will totally prevent the sending and receiving of unsolicited or potentially dangerous e-mail. By using tools such as current anti-virus software and being cautious about the sharing of your e-mail address while online you can help reduce the amount of unsolicited and hazardous e-mail you receive. Choice/Opt-out

Users are provided an account with a unique username, password (that should be changed at initial log in), and email address as part of being a resident in the community. Address information is automatically populated with the opening of the account, but may be hidden (along with other User Information) from any community directories at the discretion of the user in the "Manage Profile" section of the Site. A user may opt not to obtain an account simply by notifying his Community Administrator, at which point the account will be inactivated. Information contained in accounts that are inactivated may be stored for a period of time following inactivation. Accounts that have been inactive for some period of time may be terminated by Provider or Licensee.

Use of the account and all other aspects of the Site and the Services available on the Site thereafter are at the option of the user and requires voluntary action to participate (for example, joining a group, using the email account provided, accessing the calendar, etc). Therefore, should any user subsequently decide he/she does not wish to participate, he/she may simply remove himself/herself from the group or other feature of the Service. A user may deactivate his/her account at any time by contacting the Community Administrator.

This Site contains links to other web sites. Such a link does not imply our endorsement of that website, advertiser or product. We do not control the websites to which we link and assume no responsibility for their content or privacy policies. Any information that you provide to linked websites, or other third parties, is provided directly to such third party and is subject to that third party's privacy policy. Therefore, you should carefully review the privacy policies that apply to any sites you access from the Site or any advertisers you respond to. This privacy policy applies solely to information collected on this community Internet Site.

Advertisers and Other Users

Your communications directly with any advertiser or other user appearing on the Site are not our responsibility and are not covered by this privacy policy. You should inquire with such advertiser or user as to their privacy policies before providing any User Information.

Surveys, Promotions, Contests or Polls

From time-to-time, the Site will request information from users via surveys, promotions, contests, or polls. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and address), and demographic information (such as zip code). Contact information will be used or shared with the contest or survey sponsors to notify the winners and award prizes. Anonymous survey information will be used for purposes of monitoring or improving the use and satisfaction of this aspect of the Site. Users' User Information is not shared with third parties unless we give prior notice and a choice to opt-out of providing such information. Though we may use an intermediary to conduct these surveys or contests, they have been contractually obligated to us not to use users' User Information for any secondary purposes.

Orders

If you purchase a product or service from us, we request certain User Information from you on our order form. You must provide contact information (such as name, email, and shipping address) and financial information (such as credit card number, expiration date). This information is used by us primarily for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

We may use an outside shipping company to fulfill certain orders, and a credit card processing company to bill you for goods and services. These companies do not retain, share, store or use User Information for any other purposes.

Service Providers

We may use other third parties (such as Yellow Brix) to provide news content on the Site. When you sign up for news, we will share aggregate (but no personally identifiable) information as necessary for the third party to provide that service.

Security

This Site uses industry standard security measures to protect our users' information. When users submit sensitive information via the Site, measures are taken to protect such information is both online and off-line.

When our registration/profile form asks users to enter sensitive information, that information is encrypted and is protected with SSL encryption. While on a secure page, the lock icon on the bottom of the Web browsers (i.e. Microsoft Internet Explorer) becomes locked, as opposed to un-locked, or open, when users are just 'surfing'.

While we use SSL encryption to protect sensitive information online, we also take measures to protect user-information off-line. Only Pulte, the other third parties described in this privacy policy and employees who need the information to perform a specific job (for example, a customer service representative) are granted access to User Information. Employees are kept up-to-date on our security and privacy practices. Finally, the servers that store User Information are located in a locked and monitored facility with 24/7 security staff and certain access control systems exist to prevent authorized access to such facilities. Correcting/Updating/Deleting/Deactivating Personal Information

If a user's User Information changes (such as zip code, phone, email or postal address), or if a user no longer desires access to the Site or the Services, we provide a way to correct, update or delete/deactivate users' User Information. This can usually be done online or by contacting the Community Administrator or by emailing Customer Support at support@intellicommunities.com.

Collection of Information From Children

The Site and Services are not directed at children and are not intended for use by children. Children under the age of 18 must obtain and submit written parental consent to Provider before they can become a registered user of or use the Site. A copy of the form can be obtained by calling (888) 342-5087. Once signed, the Parental Consent shall signify your consent that your children may use the Site. You further acknowledge that children who register as users of the Site or who use your account to access the Site may from time to time be required to provide User Information in connection with using the Site, and you hereby consent to our requesting an using such User Information from your child or children as set forth herein. If at any time you wish to withdraw such consent, please notify us at support@Intellicommunities.com.

Notification of Changes

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our users are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected.

If, however, we are going to use users' User Information in a manner different from that stated at the time of collection we will notify users via email. Users will have a choice as to whether or not we use their information in this different manner. However, if users have opted out of all communication with the Site, or deleted/deactivated their account, then they will not be contacted, nor will their User Information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect User Information already stored in our database, we will post a notice on the Site notifying users of the change. In some cases where we post a notice, we will also email users who have opted to receive communications from us notifying them of the changes in our privacy practices.
